Ted is referring to this incredibly stupid lawsuit, where Capitol Records is suing Vimeo for that lip dub of Flagpole Sitta that took the internet by storm a few years ago.

Ironically, I actually bought music I heard on a Vimeo video (Alcoholic Faith Mission) that I saw here on Tumblr just yesterday. It’s true that these lip dubs fall somewhere into the fuzzy realm of fair-use, but realistically can be a great vehicle for music promotion for both up and coming artists and well known acts. I know for a fact that this video led to increased sales for Harvey Danger (and support from the lead singer!), name recognition of a then fledging video startup, and supreme jealously that we all didn’t work in an company environment as cool as Vimeos.
